1. Introduction

1.1 Who We Are

Welcome to HumorAI ("we," "us," or "our"), a mobile application designed to help users improve their sense of humor through AI‑assisted training. We operate under Codesco Consulting LTD, located at Alexandrou Panagouli 1, 6057, Larnaca, Cyprus.

1.2 Binding Agreement

By accessing or using HumorAI ("the App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use of the Service.

1.3 Age Restriction

You must be at least 14 years old to use the Service.

2. Service Description

2.1 Core Functionality

HumorAI provides AI‑generated feedback on user‑submitted jokes. The App offers a library of situational prompts, AI commentary, joke‑improvement tips, and interactive sessions.

2.2 No Guarantee of Results

Humor is subjective; we make no promise that you will find the content funny, useful, or appropriate. AI feedback may occasionally be biased, offensive, or incorrect. Some content may be considered sensitive, explicit, or inappropriate in certain contexts. User discretion is advised.

2.3 No Professional Advice

All content is for entertainment and self‑improvement purposes only. It does not constitute professional mental‑health counseling, comedic coaching, or any certified advice.

3. User Conduct & Acceptable Use

3.1 Prohibited Activities

You agree NOT to:

  • Submit content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable
  • Post or share content that violates intellectual‑property rights
  • Attempt to hack, reverse‑engineer, or disrupt the Service, servers, or networks
  • Circumvent or tamper with security measures (including rate‑limiting, authentication)
  • Automate excessive requests or perform denial‑of‑service attacks

3.2 Content Ownership

You retain rights to your own jokes and text submissions, but grant us a non‑exclusive license to store, process, and display them within the App.

3.3 User‑Generated Content

We are not responsible for user‑submitted content, including jokes that might be offensive or harmful. If you encounter prohibited content, please report it to support.

3.4 User Responsibility

You are solely responsible for the consequences of any joke, message, or content you create or share through the Service, including reputational, emotional, or legal consequences.

4. Subscriptions & Payments

4.1 Third‑Party Billing

Subscriptions are handled via the Apple App Store, Google Play Store, and/or RevenueCat. Payment terms and billing cycles follow the respective platform policies.

4.2 Trials & Renewals

Some subscriptions may offer a free trial. Unless canceled, the subscription auto‑renews at the standard rate.

4.3 Refunds

All refund or dispute requests must be directed to the app‑store provider (Apple, Google) or your payment provider. We do not issue direct refunds.

4.4 Subscription Cancellation

You may cancel any time via your App Store or Google Play account settings. Premium‑feature access ends at the close of the current billing cycle.

5. Intellectual Property

5.1 Our IP

All trademarks, logos, design elements, AI algorithms, prompts, and content created or provided by us remain our exclusive property. You may not copy, distribute, modify, or create derivative works without explicit permission.

5.2 Feedback

If you submit suggestions or ideas to improve the Service, we may use them without obligation or compensation to you.

6. Disclaimers & Limitation of Liability

6.1 “AS IS” Service

The Service is provided "AS IS" and "AS AVAILABLE." We do not warrant uninterrupted, error‑free, or secure operation, nor that defects will be corrected.

6.2 No Liability for AI‑Generated Content

Our AI may produce content that some users find offensive, inaccurate, or nonsensical. We disclaim liability for any emotional distress, reputational harm, or offense arising from such content.

6.3 Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages— including loss of profits, data, or goodwill— arising from your use of (or inability to use) the Service.

6.4 Security & Data Breaches

While we use commercially reasonable means to protect the Service, perfect security cannot be guaranteed. We are not liable for unauthorized access or hacking incidents beyond our control.

6.5 No Warranty

We make no warranty of any kind— express or implied— including fitness for a particular purpose, merchantability, or non‑infringement.

6.6 Jurisdictional Variations

Some jurisdictions do not allow certain warranty exclusions or liability limitations; relevant provisions may not apply to you.

6.7 Maximum Liability

Our maximum liability to you for any damages will not exceed the amount you paid in the last six months or US $100— whichever is lower.

7. Termination & Suspension

7.1 Termination by User

You may close your account at any time via in‑app tools or by contacting support.

7.2 Termination by Us

We may suspend or terminate your account for violations of these Terms or unlawful/abusive activity.

7.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Certain data may be retained as required by law or for legitimate business purposes.

8. Changes to the Terms

8.1 Right to Modify

We may update these Terms periodically. Material changes will be announced in‑app or via email. Continued use after changes become effective constitutes acceptance.

9. Governing Law & Disputes

9.1 Governing Law

These Terms are governed by the laws of Cyprus, without regard to conflict‑of‑law principles.

9.2 Venue

All disputes shall be resolved in the District Court of Larnaca.

9.3 Arbitration Clause

For faster, cost‑effective resolution, the parties may agree to binding arbitration or small‑claims court.

10. Service Termination

If HumorAI ceases operation due to business closure, insolvency, or other reasons, users will be notified and subscription billing disabled. No direct refunds will be issued by us; all disputes are handled by the relevant provider.

11. Content Moderation & Enforcement

11.1 Right to Moderate

We reserve the right (but not obligation) to monitor, review, edit, remove, or disable access to any user‑submitted content at our discretion, especially if it violates these Terms or is reported.

11.2 Content Reporting

If you encounter content that appears to violate these Terms, please report it using in‑app tools or by contacting support.

12. Service Modifications

12.1 Changes to Functionality

We may modify, suspend, or discontinue any part of the Service, including features, content, or AI capabilities, temporarily or permanently, without liability.

12.2 No Feature Continuity Guarantee

We make no commitment to maintain specific features or guarantee compatibility with future platforms or OS versions.

13. Privacy and Data Handling

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to those practices.

14. User Responsibility & Behavioral Disclaimer

14.1 Your Responsibility

You are solely responsible for your behavior, decisions, and interactions arising from your use of the Service, including AI‑generated content.

14.2 No Responsibility for Outcomes

We disclaim liability for harm, reputational damage, or legal repercussions resulting from your use or misuse of AI‑generated content.

15. AI Content Disclaimer

15.1 Autonomous AI Output

AI content is not pre‑screened and may be biased, offensive, or inaccurate. You accept these risks by using the Service.

15.2 Use at Your Own Risk

Do not rely on AI content for legal, medical, ethical, or other high‑stakes decisions. Do not present AI output as professional or factual information.

15.3 Legal Compliance

You are responsible for ensuring your use of the Service complies with local laws, including speech, defamation, and IP regulations.

15.4 Originality Not Guaranteed

AI outputs may unintentionally resemble copyrighted material or popular jokes. We do not guarantee originality.

15.5 Trademark References

AI‑generated jokes may reference third‑party trademarks; these references are unintentional and not endorsed by trademark holders.

16. Intellectual Property — AI Output (Clarification)

16.1 Limited Use License

All AI‑generated content is for your personal, non‑commercial use within the App. You may not reproduce or redistribute it without our written permission.

17. Force Majeure

We are not liable for delay or failure due to causes beyond our reasonable control, including natural disasters, war, strikes, pandemics, or governmental restrictions.

18. Assignment

You may not assign or transfer rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.

19. Entire Agreement & Severability

These Terms, along with the Privacy Policy, constitute the entire agreement between you and us. If any provision is unenforceable, the remainder stays in effect.

20. Children’s Privacy (COPPA Notice)

20.1 Not for Children Under 13

The Service is not intended for children under 13. We do not knowingly collect their data. If we learn we have, we will delete it promptly. Contact support@humor-ai.com with concerns.

21. Use of Behavioral Data for AI Training

21.1 Anonymized Data Usage

We may collect and analyze anonymized user interactions to improve our AI and user experience.

21.2 No Personally Identifiable Data

Data used for training is stripped of personal identifiers and processed in aggregate.

22. Dispute Resolution Attempt Before Legal Action

Before formal proceedings, contact us at support@humor-ai.com to attempt informal resolution.

22.2 Time to Respond

We will respond within 14 business days.

24. DMCA & Content Takedown Requests

24.1 Neutral Platform

We act as a neutral intermediary and do not actively monitor all user content.

24.2 Infringement Notices

To report IP violations, email support@humor-ai.com with evidence. We will investigate and act per DMCA or equivalent laws.

24.3 Takedown Procedure

Upon receiving a valid notice, we will remove offending content as required by law.

25. AI Content and Third‑Party Rights

25.1 Potential Similarities

AI‑generated content may resemble existing jokes or IP; originality is not guaranteed.

25.2 No Endorsement or Ownership

AI outputs are autonomous and not authored by any individual unless stated.

25.3 Use Caution

You are responsible for ensuring AI content does not infringe on third‑party rights.

26. Export Control & Sanctioned Jurisdictions

26.1 Compliance Statement

By using the Service, you confirm you are not located in a U.S.‑sanctioned country or on any denied‑party list.

26.2 International Use

You are responsible for complying with local laws when using the Service outside your jurisdiction.

27. Retention of Data After Termination

27.1 Limited Retention

Upon account deletion, we may retain anonymized or aggregate data for analytics and compliance.

27.2 Personal Data Deletion

Personally identifiable data will be deleted or anonymized upon request, unless legally required to retain.

28. Account Suspension Without Explanation

We reserve the right to suspend or terminate accounts at any time, with or without notice, including for suspected abuse, malicious behavior, automated access, or activity harmful to the Service integrity.

29. Legal Dispute Venue (Clarification)

All legal disputes shall be governed by the laws of Larnaca, Cyprus, and resolved in its courts, unless local consumer‑protection laws require otherwise.

30. Responsible Disclosure & Security

30.1 Bug Reports Welcome

If you discover a security vulnerability, please report it responsibly via support@humor-ai.com. While no bounty is offered, we appreciate critical reports.

30.2 No Exploit Testing

Do not test vulnerabilities on live user data or perform denial‑of‑service tests.

31. No Medical or Psychological Advice

The Service does not provide medical, psychological, or therapeutic advice. Content is for entertainment only; do not rely on it for diagnosis or treatment.

32. Hate Speech and Discrimination

We do not tolerate content promoting hate, violence, or discrimination. Such content may be removed and accounts suspended.

33. External Links Disclaimer

The Service may contain third‑party links; we are not responsible for their accuracy, policies, or practices.

34. Beta Features Disclaimer

Certain features may be released as Beta or experimental, subject to change or removal without notice.

35. Future Ownership Transfer

In the event of a merger, acquisition, or sale, your data and agreement under these Terms may be transferred to the new owner.
